They recently filed a legal motion that cited nine cases, eight of which turned out to be nonexistent. Some citations led to other cases with different names. The court discovered that at least some of these citations had been entirely invented by an AI platform.
A smaller firm called the Goody Group is also facing the same issue and ultimatum: Find copies of the cited case law and, if they cannot find it, then to demonstrate why the court should not sanction them accordingly. In this instance, the lawyers cited incorrect information generated by ChatGPT.
One of the few things scarier than the idea of your attorney using AI, is the idea that they didn’t bother to double-check the validity of their work. While artificial intelligence is a useful tool for helping shape up the format of a legal document, it’s clearly not the most reliable outlet for more complex and/or esoteric topics.
As a result of all this, both firms have acknowledged the error and emphasized the need for better AI training and implementation. Without proper verification, it’s just another fallible tool.
How to Use AI Securely (and Accurately)
Any and every AI system will outright warn users that the bots sometimes generate incorrect or “hallucinated” information.
Why does this happen? AI models are trained on vast amounts of data input by humans. That means it unavoidably contains common human errors and biases. As a result, the machine can sometimes produce plausible-sounding but false outputs. Since they lack the ability to verify facts or understand the context fully, relying too heavily on AI can lead to serious errors and misunderstandings.
To use AI more securely, consider the following steps:
- Always cross-check AI-generated information with reliable sources.
- Ensure that the AI system you use are trained with high-quality, accurate data.
- Maintain human oversight to review and validate AI outputs. In other words, double-check their work.
- Be transparent about the use of AI and its limitations.
